With the rapid impact of digital transformation across the globe, businesses are increasingly handling vast amounts of personal data. In the UK, ICO data protection regulations, under GDPR, ensure that companies process data within the permissible limits. As part of these regulations, organizations are required to pay the data protection fee in UK, which is collected by the Information Commissioner’s Office (ICO).

Who Needs to Pay the Data Protection Fee in UK?

According to ICO guidelines, any business, individual, or organization involved in processing personal data must pay the data protection fee in UK, unless they qualify for ICO exemptions. Organizations that fall under the ICO exemptions category include:

The list of exempted category includes:

  • Public Authorities: Categorized based on staff numbers only.
  • Charities: Required to pay only the Tier 1 fee.
  • Small occupational pension schemes: Also subject to only the Tier 1 fee.

Different Tiers of the Data Protection Fee

The amount an organization needs to pay depends on its turnover and number of employees. There are three tiers:

Tier 1: For micro-organizations with a turnover of £632,000 or less and fewer than 10 employees. The applicable data protection fee in UK is £40.

Tier 2: For small and medium-sized businesses with a turnover of £36 million or less and fewer than 250 employees. The applicable fee is £60.

Tier 3: For large organizations exceeding the above limits. The applicable fee is £2,900.

Penalties for Non-Compliance

Failing to pay the data protection fee can result in a fine of up to £4,350 imposed by the ICO. To avoid penalties, businesses should determine their eligibility and ensure compliance with ICO data protection regulations.
